The President called the emoluments clause of the Constitution ‘phony.’ However, the 2nd Circuit Court of Appeals appears to disagree. The court announced that it will hear arguments over his potential violation of that clause in early December. Meanwhile, the Manhattan district attorney struck a deal with the President’s lawyers over the President’s tax returns. But depending on the opinion of the 2nd Circuit, either side could take the case to the Supreme Court.
