The Supreme Court returns to the bench Monday and one of the first cases it will take up will examine the use of affirmative action in undergraduate admissions.
The justices will hear arguments in Fisher v. the University of Texas Austin beginning October 10. The case was brought by a white student who did not gain admission to the Texas university, which does consider race as part of its admissions process. The individual alleges that less qualified applicants gained entry due to the color of their skin.
